How to use this site, what our numbers mean, and exactly how our guarantees work.

Pre-launch draft. These terms are being finalised ahead of launch, and are still to have a final independent legal review. The guarantee terms below reflect how the guarantees work; the binding detail for any engagement is set out in your services agreement.

This website is operated by Tuyo Capital Pty Ltd (ABN 18 697 376 766), trading as FKD Group (“FKD”, “we”, “us”, “our”). These terms apply to your use of this website. They’re written plainly on purpose. Nothing here takes away rights you have under the Australian Consumer Law.

Using this website

You’re welcome to read, share and link to this site. Don’t use it to break the law, don’t try to interfere with how it runs, and don’t copy our content to pass off as your own. The content here is general information about what we do. It isn’t professional advice for your specific business, and it isn’t a binding offer. Any work we do for you is set out in a separate services agreement.

What our numbers mean

Figures on this site, like “1 in 3 missed calls won back”, “15+ hours a week”, “8–12 leaks” or dollar ranges, are typical ranges and projections drawn from what this kind of work commonly turns up. They are not a promise of the exact result your business will get, and they’re not based on a long client track record. We’re upfront that we’re new. Your audit gives you the real numbers for your business before you spend anything beyond it. Where we make a specific promise, it’s the guarantee set out below.

Our guarantees: the full terms

We back our work with two guarantees and one ownership promise. Here’s exactly how each one works. The specific mechanics for your engagement (timing, what’s measured and how) are confirmed in writing in your services agreement before any paid work starts.

1. The refundable audit

You pay a fixed fee for a half-day on-site audit. About a week later we give you a written map of where your business is losing time and money, with an estimate of what each fix is worth in hours and dollars.

  • The promise: if that map doesn’t identify at least three fixes we estimate to be worth more than $20,000 a year each, we refund the audit fee in full.
  • “Worth” means our reasonable, good-faith estimate of the annual time and money a fix would save or recover, set out and explained in the map so you can see the working.
  • You keep the map either way, refunded or not, the findings are yours to use.
  • To claim: tell us within 14 days of receiving the map and we’ll process the refund to your original payment method.

2. The 90-day result

If you go ahead with an implementation, we agree the scope up front and build it within 90 days.

  • The promise: by day 90 you’ll have at least 15 hours a week given back across the business and a result you can point to, or we keep working at no extra charge for another 30 days until you do.
  • How it’s measured: against a simple baseline we agree with you at the start (the hours currently spent on the tasks in scope), reviewed together at day 90. The method is written into your services agreement so there’s no argument about it later.
  • Reasonable cooperation: the guarantee assumes your team gives us the access and information we need and uses what we build. If something outside our control blocks the work, we’ll talk it through fairly.

3. What we build is yours

The tools and set-ups we build for you are yours to keep. We don’t hold your data hostage and we don’t lock you in. If you stop working with us, you keep what we’ve built and your data stays yours.

Intellectual property

The design, words and graphics on this website belong to FKD Group. What we build for you as part of an engagement is dealt with in your services agreement (and, per the promise above, is yours).

Liability

Our services come with guarantees under the Australian Consumer Law that can’t be excluded. Nothing in these terms limits those rights. Beyond what the law requires, and to the extent the law allows, our liability for the website and its general information is limited. The website is provided “as is” and we don’t guarantee it will always be available or error-free.

Governing law

These terms are governed by the laws of New South Wales, Australia.

Changes

We may update these terms from time to time. The “last updated” date above tells you when they last changed.
